Order To Take Action & Demolition Bids

When compliance of unsafe structures cannot be obtained, the properties are taken to an Order To Take Action Hearing. All parties having interest in the property are notified and the cases are brough before the hearing officer. The hearing officer may deem the property unsafe and order the property to be demolished.

When is a structure deemed unsafe?

A building or structure may be deemed unsafe if it does not provide adequate means of egress, creates a fire hazard, or is otherwise dangerous to human life. Structures may also be considered unsafe if, due to inadequate maintenance, dilapidation, or abandonment, they pose a risk to public health, safety, or welfare. Unsafe structures are considered public nuisances and must be addressed through repair, rehabilitation, or demolition in accordance with applicable codes and ordinances.

How does the OTA process work?

When a Code Enforcement Officer identifies a violation, a written notice (order to abate) is issued to the responsible party. If the violation is not corrected within the given timeframe, the case is forwarded to the Building Commissioner and scheduled for a hearing. At the hearing, both the Code Officer and the responsible party may present information. After review, the Hearing Officer will determine whether a nuisance or unsafe condition exists. Is the final decision always demolition?

No. Demolition is considered a last resort unless there is an emergency situation that poses an immediate threat to public health or safety. If a structure is demolished—either by the City or privately—a clean hole inspection is required. Please provide at least 24 hours’ notice to schedule this inspection.
